The Municipality of Făgăraş is being sued by an employee who is demanding her rights and moral damages of 100,000 lei. Diana Gribincea, the director of the Municipal House of Culture of Făgăraş, has addressed the Braşov Tribunal claiming CL Făgăraş in file no. 1767/25 May 2018, in which she requests that the Municipality of Făgăraş and the Local Council be ordered to pay her the sum of 5,076 lei representing consultations, analyses and assistance during childbirth and another 1,000,000 lei for „violation of the right to honor”. The payment of these amounts, if Gribincea wins the case, will be borne by the local budget.
„I do not agree to pay the lawyer’s fees from public funds, in this sense our interests are contrary. We will guarantee the ten councilors who generated this crisis,” said Gheorghe Sucaciu, the mayor of Făgăraș Municipality, in plenary.
Lawyer’s fee, 6,000 lei
The subject was debated in the immediate meeting of the Făgăraş Local Council held on 27.08.2018, with a draft decision initiated by the mayor of the municipality himself, which proposed hiring a lawyer to represent „the interests of the Făgăraş Local Council in File no. 17167/62/2018 in which the Făgăraş Local Council is the defendant, pending before the Braşov Tribunal”. All 16 local councilors gathered in plenary voted unanimously that the interests of the Local Council be represented by lawyer Pernicek Călin, and that his fee, borne from the local budget, be 6,000 lei. „The lawyers we consulted advised us to continue the process because we will win the case. At the next meeting, the lawyer will appear in plenary and give his opinion,” said local councilor Florin Alexandru. Prior to this meeting, a commission was established by HCL no. 233/2018 to hire this lawyer. Four local councilors dealt with this issue, Valentin Clonţ, Cătălin Cârje, Alexandru Mazilu and Florin Alexandru. In the action initiated by the director of the Făgăraş Culture House, 10 local councilors are nominated.
The scandal at the leadership of the House of Culture
We remind you that in the case of the House of Culture, a crisis was created due to the failure to comply with the regulations and deadlines imposed for organizing the competition for the management position, given that at the beginning of November 2017, the term of office of Diana Gribincea as manager, 2014-2017, ended. Therefore, the Făgăraş ATU was obliged to evaluate the activity of the unit and implicitly of the manager Diana Gribincea, and the Făgăraş Local Council adopted HCL no. 190 in the ordinary meeting of August 31, 2017, which established the competition committee and the Regulations for the conduct and organization of the competition. But because the HCL was not applied, in the Făgăraş Local Council plenary session of October 31, 2017, the competition for the management of the House of Culture was returned to, so as not to affect the activity of the institution due to the failure to organize the competition. Another commission and another regulation were stipulated in another HCL project that was put to the vote but did not pass, 10 councilors voted „against” (Florin Alexandru, Andreea Suciu, Lucian Lup, Ion Negrilă, Alexandru Motoc, Sorin Mănduc, Antoniu Gabor, Remus Mogoş, Alexandru Mazilu, Cătălin Cârje), three abstained and only four were „for”. The 10 local elected officials are now cited in the file pending at the Braşov Tribunal. In December, Diana Gribincea became unemployed and on maternity leave, and the position of manager of the House of Culture was filled for a fixed period, 120 days, by order signed by the mayor. „The mandate of manager Diana Gribincea ended on November 6. Considering the situation created in the Local Council by the failure to fulfill the competition procedures for the position of manager, the legislation obliges me to appoint another person to lead the institution. The first condition was that the person appointed should not be part of any political party. I appointed Bogdan Unureanu who resigned from the PNL,” said Mayor Gheorghe Sucaciu at the time. The interim manager, Bogdan Ungureanu, began his activity after November 7. During the 120 days, the competition was organized, and the only candidate was Diana Gribincea.
